Terms of Service

Requirements

• Be at least 13 years old (or the minimum age required in your country)
• Be able to enter into a legally binding contract
• Not be a person prohibited from using our services under applicable laws
• Not have been previously banned from our services

Minors

Minors aged 13 to 18 must have permission from their parents or legal guardians.

Account Creation

• You must provide accurate and complete information
• You may only create one personal account
• You are responsible for maintaining the confidentiality of your password
• You are responsible for all activities under your account

Account Security

• You must immediately notify us of any unauthorized use
• We are not responsible for losses due to unauthorized access if you have not protected your credentials
• You must not share your login credentials

License Terms

• Non-exclusive: other users have the same rights
• Limited: for personal and non-commercial use only
• Non-transferable: you cannot assign your rights
• Revocable: we can withdraw it in case of violation

Your Rights to Your Content

You retain ownership of the content you create and post on BimStrength.

License Granted to BimStrength

• By posting content, you grant us a worldwide, non-exclusive, royalty-free, transferable and sub-licensable license for the duration of rights protection.
• This license allows us to: host, store and display your content; distribute and promote your content on our services; create derivative works (resizing, formatting, etc.); use your content for platform marketing purposes.

Your Responsibility

• You have all necessary rights to the content you post
• Your content does not violate third-party rights
• Your content complies with our Community Guidelines
• Your content complies with all applicable laws

Regarding Content

• Post illegal, defamatory, obscene or offensive content
• Share copyrighted content without authorization
• Post personal information of others without consent
• Spread false information or misleading content

Regarding the Platform

• Use robots, scripts or automated tools
• Attempt to bypass security measures
• Interfere with service operations
• Create fake accounts or impersonate others
• Artificially manipulate engagement (likes, views, followers)

Regarding Other Users

• Harass, intimidate or threaten other users
• Send unsolicited communications (spam)
• Collect information about other users
• Solicit passwords or personal information

Regarding Commercial Activities

• Use our services for unauthorized commercial purposes
• Sell or transfer your account
• Advertise without our written authorization
• Solicit other users for commercial purposes

Our Rights

• Modify, suspend or discontinue services at any time
• Remove or modify any content without notice
• Suspend or terminate accounts in case of violation
• Modify these terms with prior notification
• Cooperate with authorities in case of illegal activities

By You

You can delete your account at any time via the application settings or by contacting us.

By BimStrength

• We may suspend or terminate your account if:
• You violate these terms or our policies
• You create a legal risk for BimStrength
• Your account has been inactive for more than 12 months
• We stop providing our services

Effects of Termination

• Your access to services will be revoked
• Your content may be deleted (except for legal retention obligations)
• Licenses you granted us survive for content shared by others
• Certain provisions survive termination (liability, disputes, etc.)

Services Provided "As Is"

BimStrength is provided "as is" and "as available" without warranty of any kind.

Warranty Exclusions

• We do not guarantee that services will be uninterrupted or error-free
• That results obtained will be accurate or reliable
• That defects will be corrected
• That services will meet your expectations

Limitation of Damages

To the fullest extent permitted by law, BimStrength will not be liable for: loss of profits, data or customers; indirect, incidental or consequential damages; any amount greater than the higher of: (a) €100 or (b) the amounts you have paid us in the past 12 months.

Applicable Law

These terms are governed by French law.

Mediation

Before any legal action, you agree to attempt an amicable resolution by contacting us. We commit to responding within 30 days.

Competent Jurisdiction

In case of mediation failure, French courts will have jurisdiction.

Statute of Limitations

Any claim must be made within one year of the event in question.

Entire Agreement

These terms, along with our other policies, constitute the entire agreement between you and BimStrength.

Severability

If a provision is found invalid, the other provisions remain in effect.

Waiver

Failure to exercise a right does not constitute a waiver of that right.

Assignment

You cannot assign your rights without our consent. We can freely assign ours.
