Terms of Service

Key Terms

• "BimStrength", "we", "us", "our": refers to BimStrength SAS, a French company (société par actions simplifiée)
• "Platform": the BimStrength ecosystem including all websites, mobile applications, and services
• "Services": all features, tools, and content available through the Platform
• "User", "you", "your": any person who accesses or uses the Platform
• "Content": any text, video, photo, audio, data, or other material uploaded, shared, or created on the Platform
• "Health Data": any data related to physical health, fitness, nutrition, body measurements, or wellness
• "Coach": a User who offers professional coaching services through the Coach Marketplace
• "Ecosystem": the suite of interconnected BimStrength applications (Social, Training, Nutrition, Track, Coach, Access)

General Requirements

• Be at least 16 years old (or the minimum digital age of consent in your country)
• Be legally capable of entering into a binding contract
• Not be prohibited from using our services under any applicable law
• Not have been previously banned from our services

Minors (16-18)

Users aged 16 to 18 must obtain verifiable permission from a parent or legal guardian. Certain features — including the Coach Marketplace, payment features, and direct messaging with non-followed users — are restricted to users aged 18 and over.

Coach Eligibility

To offer coaching services on the Platform, you must be at least 18 years old and hold valid professional credentials where required by your jurisdiction.

BimStrength Social (bimstrength.com)

The video social network for sharing and discovering content related to the human body across 12 categories: sport & physical activity, beauty & aesthetics, wellness, nutrition & food, body & knowledge, health & prevention, mental & performance, science & research, body & ages of life, disability & adaptation, body expression, and equipment & gear.

BimStrength Training (training.bimstrength.com)

Workout creation and tracking, exercise library, personalized training programs, and performance statistics.

BimStrength Nutrition (nutrition.bimstrength.com)

Food tracking, meal planning, nutritional goal management, and macro/micro nutrient analysis.

BimStrength Track (track.bimstrength.com)

Body tracking including weight, measurements, progress photos, goals, and trend analysis.

BimStrength Coach (coach.bimstrength.com)

Professional coaching tools: client management, custom program creation, scheduling, messaging, marketplace, and review system.

BimStrength Access (access.bimstrength.com)

Gym check-in system, attendance tracking, leaderboards, subscription management, and gym community features.

Account Creation

• You must provide accurate and complete information
• You may register via email/password or through third-party authentication providers (such as Google)
• You may only create one personal account
• A single account grants access to all applications in the BimStrength ecosystem
• You are responsible for maintaining the confidentiality of your credentials
• You are responsible for all activities under your account across all applications

Account Security

• You must immediately notify us of any unauthorized use of your account
• We are not responsible for losses due to unauthorized access if you have not protected your credentials
• You must not share your login credentials with any third party
• We recommend using a strong, unique password and enabling two-factor authentication when available

Account Types

• Personal Account: for individual use of the Platform
• Coach Account: for professionals offering coaching services (requires identity verification)
• Brand Account: for businesses and organizations (requires approval and verification)

License Terms

• Non-exclusive: other users have the same rights
• Limited: for personal and non-commercial use only (except for authorized Coach accounts)
• Non-transferable: you cannot assign your rights to another party
• Revocable: we can withdraw it in case of violation of these terms
• Worldwide: valid in all countries where our services are available

Restrictions

• You may not copy, modify, or create derivative works from our services
• You may not reverse-engineer, decompile, or disassemble our software
• You may not use our services to build a competing product or service
• You may not access our services through unauthorized APIs or automated means

Your Rights to Your Content

You retain ownership of all Content you create and post on BimStrength, including videos, photos, text, training programs, recipes, meal plans, and other materials.

License Granted to BimStrength

• By posting Content, you grant us a worldwide, non-exclusive, royalty-free, transferable and sub-licensable license for the duration of intellectual property rights protection.
• This license allows us to: host, store, and display your Content; distribute and promote your Content across all BimStrength applications; create derivative works (resizing, formatting, thumbnails); use your Content for platform marketing and promotional purposes; make your Content available through our structured video library.

Your Responsibility

• You have all necessary rights to the Content you post
• Your Content does not infringe any third-party intellectual property rights
• Your Content complies with our Community Guidelines
• Your Content complies with all applicable laws and regulations
• You are solely responsible for any health, fitness, or nutritional advice shared through your Content

Content Removal

We may remove any Content that violates these terms, our policies, or applicable law, without prior notice. We are not obligated to store or maintain any User Content indefinitely.

Nature of Data

• Training data: workout logs, exercise history, performance metrics, personal records
• Nutrition data: food intake logs, calorie tracking, macronutrient data, meal plans
• Body data: weight, body measurements, progress photos, body composition estimates
• Gym data: check-in history, attendance patterns, location data
• This data is classified as health data under GDPR Article 9 and receives enhanced protection

Medical Disclaimer

• BimStrength is NOT a medical service and does not provide medical advice, diagnosis, or treatment
• Content shared by users and coaches should not replace consultation with a qualified healthcare professional
• Always consult a healthcare professional before starting any new exercise or nutrition program
• We are not liable for injuries or health issues resulting from information found on our Platform
• AI-generated recommendations and suggestions are for informational purposes only

Cross-Application Data Sharing

Your health and fitness data may be shared across BimStrength applications to provide an integrated experience (e.g., training data visible in Track, nutrition goals linked to training programs). You can manage these sharing preferences in your account settings.

Premium Features

BimStrength Premium offers an ad-free experience, advanced features, and enhanced tools across the ecosystem. The specific features included may vary and evolve over time.

Billing

• Subscription fees are charged in advance on a monthly or annual basis
• Prices are displayed inclusive of applicable taxes
• Payment is processed securely through our third-party payment providers (Stripe, Apple Pay, Google Pay)
• We do not store your full credit card information directly — it is handled exclusively by our PCI-DSS compliant payment processors

Cancellation & Refunds

• You may cancel your subscription at any time through your account settings or the respective app store
• Cancellation takes effect at the end of the current billing period
• No pro-rata refunds are provided for partial billing periods
• EU residents benefit from a 14-day right of withdrawal for new subscriptions, provided the service has not been fully used
• We reserve the right to modify subscription prices with 30 days' prior notice

Free Trial

If offered, free trials automatically convert to a paid subscription at the end of the trial period unless cancelled beforehand. One free trial per user and per payment method.

Coach Obligations

• Maintain valid and current professional certifications where required by law
• Provide accurate information about qualifications, experience, and pricing
• Deliver services with professional care and competence
• Respect client confidentiality and data privacy
• Comply with all applicable professional regulations in your jurisdiction
• Refrain from providing medical diagnoses or treatments

Client-Coach Relationship

• BimStrength facilitates the connection between coaches and clients but is not party to the coaching agreement
• Coaches are independent contractors, not employees or agents of BimStrength
• BimStrength is not responsible for the quality, safety, or legality of coaching services provided
• Disputes between coaches and clients should be resolved directly between the parties

Marketplace Fees

BimStrength may charge a commission on transactions completed through the Coach Marketplace. Current commission rates are communicated to coaches upon registration and may be updated with 30 days' notice.

Regarding Content

• Post illegal, defamatory, obscene, or offensive content
• Share copyrighted content without proper authorization
• Post personal information of others without their explicit consent
• Spread false medical, nutritional, or fitness information that may cause harm
• Promote dangerous substances, illegal steroids, or unapproved supplements
• Share misleading transformation results or fabricated testimonials

Regarding the Platform

• Use bots, scripts, scrapers, or automated tools to access our services
• Attempt to bypass security measures, rate limits, or access controls
• Interfere with service operations or infrastructure
• Create fake accounts or impersonate other individuals or organizations
• Artificially manipulate engagement metrics (likes, views, followers, reviews)
• Access or attempt to access other users' accounts or private data

Regarding Other Users

• Harass, intimidate, bully, or threaten other users
• Send unsolicited commercial communications (spam)
• Collect or harvest information about other users without consent
• Solicit passwords, financial information, or other sensitive data
• Stalk or repeatedly contact users who have requested no further contact

Regarding Commercial Activities

• Use our services for unauthorized commercial purposes
• Sell, rent, or transfer your account to another party
• Advertise third-party products or services without written authorization
• Solicit users for external services that compete with BimStrength
• Circumvent the Coach Marketplace to avoid platform fees

BimStrength Property

• The BimStrength name, logo, branding, and all associated trademarks are the exclusive property of BimStrength SAS
• The platform design, source code, algorithms, and architecture are protected by intellectual property law
• Our structured video library classification system is proprietary
• You may not use our intellectual property without prior written consent

Copyright Claims (DMCA / EU Directive)

If you believe your copyright has been infringed, contact us at legal@bimstrength.com with: a description of the copyrighted work, the URL of the infringing content, your contact information, and a statement of good faith. We will process valid claims promptly in accordance with applicable law.

Platform Management

• Modify, update, suspend, or discontinue any service or feature at any time
• Remove or modify any Content that violates our policies without prior notice
• Suspend or permanently terminate accounts in case of terms violations
• Modify these terms with 30 days' prior notification to users
• Cooperate with law enforcement and regulatory authorities as required by law
• Implement new features, modify pricing, or restructure the ecosystem

Third-Party Integrations

• Our Platform integrates with third-party services (Google OAuth, payment processors, analytics, advertising networks)
• Your use of third-party services is governed by their respective terms of service and privacy policies
• We are not responsible for the content, accuracy, or practices of third-party services
• We do not endorse any third-party products or services linked from our Platform

External Links

Content on our Platform may contain links to external websites or services. We are not responsible for the content, privacy practices, or availability of these external sites.

By You

You can delete your account at any time via your account settings or by contacting support@bimstrength.com. Account deletion removes your access to all BimStrength applications simultaneously.

By BimStrength

• We may suspend or terminate your account if:
• You violate these terms, our Community Guidelines, or any of our policies
• You create a legal, security, or reputational risk for BimStrength
• Your account has been inactive for more than 24 months
• We are required to do so by law or regulatory order
• We discontinue providing our services

Effects of Termination

• Your access to all BimStrength services will be immediately revoked
• Your Content may be deleted after a 30-day grace period (except where legal retention applies)
• Licenses you granted us survive for Content already shared or distributed by other users
• Your health and fitness data will be deleted per our data retention policy
• Active Premium subscriptions will not be renewed; no refund for the current billing period
• Certain provisions survive termination (liability, disputes, intellectual property)

Services Provided "As Is"

BimStrength services are provided "as is" and "as available" without warranty of any kind, whether express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose.

Warranty Exclusions

• We do not guarantee that services will be uninterrupted, secure, or error-free
• That health, fitness, or nutritional information will be accurate or appropriate for your personal situation
• That results obtained through coaching services will meet your expectations
• That defects will be corrected within a specific timeframe
• That our services will be compatible with all devices, operating systems, or browsers

Limitation of Damages

To the fullest extent permitted by applicable law, BimStrength will not be liable for: loss of profits, data, business opportunities, or goodwill; indirect, incidental, special, or consequential damages; personal injury or health issues resulting from reliance on Platform content; any amount greater than the higher of (a) 100 EUR or (b) the total amounts you have paid to BimStrength in the 12 months preceding the claim.

Force Majeure

We are not liable for failures or delays caused by circumstances beyond our reasonable control, including natural disasters, pandemics, government actions, cyberattacks, or third-party infrastructure failures.

Applicable Law

These terms are governed by French law, regardless of your place of residence. The provisions of the United Nations Convention on Contracts for the International Sale of Goods (CISG) do not apply.

Mediation

Before initiating any legal action, you agree to attempt amicable resolution by contacting us at legal@bimstrength.com. We commit to responding within 30 days. EU consumers may also use the EU Online Dispute Resolution platform at ec.europa.eu/odr.

Competent Jurisdiction

In case of mediation failure, the competent courts of Paris, France will have exclusive jurisdiction, except where mandatory consumer protection laws in your country of residence provide otherwise.

Statute of Limitations

Any claim related to these terms or our services must be filed within two (2) years of the event giving rise to the claim.

Entire Agreement

These terms, together with our Privacy Policy, Cookie Policy, and Community Guidelines, constitute the entire agreement between you and BimStrength regarding use of our services.

Severability

If any provision of these terms is found invalid or unenforceable by a court of competent jurisdiction, that provision will be limited to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

No Waiver

Our failure to enforce any right or provision of these terms does not constitute a waiver of that right or provision.

Assignment

You may not assign or transfer your rights under these terms without our prior written consent. We may freely assign our rights and obligations, including in connection with a merger, acquisition, or sale of assets.

Updates to These Terms

We may update these terms from time to time. We will notify you of material changes at least 30 days before they take effect via email, in-app notification, or a prominent notice on our websites. Continued use of our services after changes take effect constitutes your acceptance of the updated terms.
